Touch Networks ("Touch") is committed to protecting information about its customers ("Personal Information") and recognises that its customers' privacy is very important and that customers have a right to control their Personal Information.
Unless a customer gives Touch explicit consent to act otherwise, the following policies will govern how Touch handles its customers' personal information and safeguards their privacy.
2. Touch is committed to the best-practice privacy standards
Touch is committed to protecting its customers' Personal Information consistently with the requirements set out in The Privacy Amendment (Private Sector) Act 2000 ("Privacy Act").

Touch will not collect or monitor any Personal Information about its customers without their consent unless it is necessary:

• To provide its customers with a service that they have requested.

• To protect the rights or property of Touch, any Touch customer, or any member of the public.
• To lessen a serious threat to a person's health or safety.
Touch may be provided with information through customers entering details on the company's Electronic Service Delivery System (ESDS) when using particular services.
The amount and type of information collected will vary depending on which services are used on Touch's ESDS. Touch only collects information from its customers' use of its ESDS.
4. Using and disclosing personal information
Touch will not use or disclose any information about its customers without their consent unless:
• Required by law.
• It is necessary to provide customers or users of the website with a service which they have requested.
• It is necessary to implement its terms of service.
• It is necessary to protect the rights or property of Touch, any Touch user, or any member of the public.
• It is necessary to lessen a serious threat to a person's health or safety.
Touch recognises the trust entrusted in it when its customers and website users provide personal information. In order to deliver a service Touch may sometimes share customers' and users' Personal Information with a provider of products and services distributed through the Touch ESDS. Touch will not otherwise disclose personal information to other companies without consent.
The information (both personal and other that Touch collects through its customers' use of the ESDS will not be traded, sold, licensed or used for commercial marketing purposes. Touch will not use Personal Information collected through its customers' use of the ESDS for purposes unrelated to the stated purpose (if any). Touch will not disclose Personal Information collected through its customers' use of the ESDS for purposes unrelated to the stated purpose (if any) unless such disclosure is authorised by law.
5. Storage and security of your Personal Information
Touch will endeavour to take all reasonable steps to keep secure any information which it holds about its customers secure and up-to-date. Information is stored on secure servers that are protected in controlled facilities.
In addition, Touch's employees and data processors are obliged to respect the confidentiality of any Personal Information held by Touch. However, Touch will not be held responsible in the event of unauthorised access to such Personal Information.
6. Changes in policy
Touch reserves the right to change its privacy policy at any time. Any change of policy will be notified by posting an updated version of the policy on Touch's website.
